Article 2 – Purpose and scope
These general terms and conditions of sale (hereinafter “GTC”) govern all sales of products concluded between the Seller and any non-commercial individual (hereinafter “the Customer”) on the Website. Any order placed on the Website implies the Customer’s full and unconditional acceptance of these GTC, in the version in force on the date of the order. The Seller reserves the right to amend them at any time; the applicable GTC are those accepted by the Customer upon confirmation of their order.
Article 3 – Products
The products offered for sale are those listed on the Website, subject to availability. They are described and presented as accurately as possible; the photographs and descriptions illustrating the products are not contractually binding and do not engage the Seller’s liability.
Sale of alcohol – prohibited to minors. Alcoholic beverages sold on the Website are exclusively reserved for adults aged 18 or over, in accordance with Article L.3342-1 of the Public Health Code. By confirming their order, the Customer certifies that they are at least 18 years of age on the date of the order. Alcohol abuse is dangerous to health; please drink in moderation.
Article 4 – Prices
Product prices are quoted in euros, inclusive of all taxes (TTC), excluding delivery charges. Delivery charges are calculated based on the weight of the parcel and the destination, and are disclosed to the Customer before the order is finally confirmed. The Seller reserves the right to amend its prices at any time; products are invoiced on the basis of the prices in force at the time the order is placed.
Article 5 – Order
The Customer selects the products they wish to order, checks the details in their basket, and then confirms their order after having read and accepted these Terms and Conditions of Sale. The sale is deemed to have been concluded upon confirmation of the order, as evidenced by the sending of a summary email to the address provided by the Customer. The Seller reserves the right to refuse or cancel any order for a legitimate reason, in particular in the event of product unavailability, a previous dispute or an order that is manifestly abnormal.
Article 6 – Payment
Payment for purchases is made online by credit card, via the secure Stripe and BNP payment platforms. Bank details are transmitted in encrypted form (SSL protocol) and are not stored on the Seller’s servers at any time. The order is only processed once payment has been successfully validated.
Article 7 – Delivery
Products are delivered to the delivery address specified by the Customer when placing the order, within the service areas listed on the Website. Delivery times are provided for guidance only; a tracking number is sent by email as soon as the parcel is dispatched. The Customer is required to check the condition of the parcel upon receipt: in the event of damage or a missing item, they must make specific, written reservations with the carrier and inform the Seller within 48 hours.
Article 8 – Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give any reason for their decision or incur any penalties. To exercise this right, the Customer must notify the Seller of their decision by means of an unambiguous statement sent to contact@pepites-en-champagne.fr. The products must be returned in their original packaging, complete and in perfect condition for resale, at the Customer’s expense. A refund of the amounts paid (excluding return postage costs) will be issued within 14 days of receipt of the returned products or proof of their dispatch.
Article 9 – Retention of title
The products remain the property of the Seller until full payment of their price by the Customer. However, the risk of loss, theft or damage passes to the Customer upon delivery of the products to the Customer or to a third party designated by them.
Article 10 – Statutory Guarantees
Irrespective of any commercial warranty, the Customer is entitled to the statutory warranty of conformity (Articles L.217-3 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code). As such, the Customer may request the repair or replacement of the non-compliant product, or failing that, a price reduction or the cancellation of the sale, in accordance with the conditions and time limits laid down by law.
Article 11 – Liability and Responsible Consumption
The Seller shall not be held liable for any damage resulting from the misuse or inappropriate consumption of the products. Wines and champagnes must be consumed in moderation. Furthermore, the Seller shall not be held liable for any indirect damage suffered by the Customer.
Article 12 – Force majeure
The Seller shall not be held liable in the event of non-performance or delay in the performance of any of its obligations resulting from an event of force majeure, within the meaning of Article 1218 of the Civil Code and the case law of the French courts.
Article 13 – Personal Data
The Customer’s personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR). To find out the nature of the data processed, the purposes for which it is used, how long it is retained and how to exercise your rights, please consult our Privacy Policy.
Article 14 – Mediation and Disputes
These General Terms and Conditions are governed by French law. In the event of a dispute, the Customer shall first contact the Seller to seek an amicable solution. In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Customer may also, free of charge, refer the matter to a consumer mediator with a view to resolving the dispute amicably. In the absence of an agreement, the French courts shall have exclusive jurisdiction.
